Fresh Collective is operated by Lindsey Hilliard, ABN - 95 563 881 304.
This Privacy Policy explains how Fresh Collective collects, holds, uses and shares personal information when you use the Fresh Collective platform.
It also explains:
- what information we collect
- why we collect it
- who may have access to it
- how information may be processed by service providers
- how you can access or correct your information
- how you can raise a privacy concern
Fresh Collective is for people aged 18 years and over.
This Policy should be read alongside the Terms of Use, Membership Terms, Creator Agreement, Community Guidelines and other Fresh Collective policies that apply to your use of the platform.
Our approach to privacy
Fresh Collective is built around communities and relationships.
That means some information needs to move between:
- Fresh Collective
- Creators
- Members
- payment providers
- email providers
- hosting and technology providers
Our approach is to collect and use personal information only where it is reasonably connected with operating Fresh Collective, providing the services people have chosen to use, maintaining security, meeting legal obligations or another legitimate purpose described in this Policy.
We do not sell personal information.
Where Australian privacy laws apply to Fresh Collective, we comply with those laws.
More broadly, we aim to manage personal information consistently with the transparency, security and responsible information-handling principles reflected in Australian privacy law.
What is personal information?
Personal information is information or an opinion about an identified person, or a person who is reasonably identifiable.
It may include things such as:
- your name
- email address
- profile information
- account information
- purchase history
- booking information
- communications
- information about how you use Fresh Collective
Some information may become personal information when combined with other information.
Sensitive information
Some personal information receives additional protection under Australian privacy law.
This may include information about matters such as:
- health
- racial or ethnic origin
- religious beliefs
- political opinions
- sexual orientation
- criminal record
- biometric information
- other categories defined as sensitive information by law
Fresh Collective does not require health or other sensitive information simply to create a standard account or use the core platform.
You should not use ordinary profile, community or messaging fields as a substitute for an appropriate confidential health, medical or professional assessment process.
If Fresh Collective introduces a feature that intentionally collects sensitive information, we will provide appropriate information about that collection and obtain consent where required.
Sensitive information you choose to share
Fresh Collective includes communication and community features.
It is possible that a person may voluntarily disclose sensitive information within:
- a Conversation
- a Message
- a Community Contribution
- communication with a Creator
- communication with Fresh Collective
If you voluntarily provide sensitive information in this way, Fresh Collective may receive and process that information as part of providing, securing or moderating the relevant service.
You should think carefully before sharing sensitive or highly private information through a community feature.
Who this Policy applies to
This Policy applies to personal information Fresh Collective handles about people including:
- visitors
- account holders
- Members
- Creators
- people booking Gatherings
- people making purchases
- people communicating through the platform
- people contacting Fresh Collective for support
- other people whose personal information is legitimately handled through Fresh Collective
Information we may collect
The information we collect depends on how you use Fresh Collective.
Account information
When you create or manage an account, we may collect information such as:
- name
- email address
- display name
- account identifiers
- profile image or avatar
- profile information you choose to provide
- account settings
- verification status
- login and security information
We may also keep records relating to:
- account creation
- account changes
- verification
- password resets
- security events
- account closure
Profile information
You may choose to provide information for your Fresh Collective profile.
Depending on available features, this may include:
- display name
- profile image
- biography or introduction
- interests
- other information you choose to share
The visibility of profile information may depend on:
- the feature
- the Collective
- your membership
- the Creator's settings
- whether information has been intentionally made public
You should only include information in your profile that you are comfortable sharing with the audience identified by the platform.
Collective membership information
When you join or participate in a Collective, we may collect and hold information about:
- the Collectives you belong to
- your membership status
- when you joined
- your role within the Collective
- access granted to you
- active or expired access
- membership changes
- invitations
- removal or suspension information where applicable
This information helps Fresh Collective determine what areas, content and features you are permitted to access.
Purchase and transaction information
If you make or receive payments through Fresh Collective, we may collect information about:
- the offering purchased
- the amount
- payment status
- transaction identifiers
- payment dates
- payment schedule
- instalment status
- subscriptions
- refunds
- payment failures
- payment disputes
- access granted by the purchase
- Creator payout and reconciliation information
Fresh Collective does not intend to store complete payment card details.
Payment card and payment-method information is handled by our payment provider, currently Stripe.
Fresh Collective may receive information from Stripe that is necessary to manage a transaction, such as:
- payment status
- transaction identifiers
- limited payment-method information
- refund information
- dispute information
- Stripe account or customer identifiers
Stripe handles payment information under its own terms and privacy practices.
Creator information
If you become a Creator, we may collect additional information associated with operating your Collective.
Depending on the features you use, this may include:
- Creator profile information
- Collective information
- Creator plan information
- subscription information
- transaction information
- payout records
- payment-provider identifiers
- refund and reconciliation records
- Creator settings
- moderation information
- communications with Fresh Collective
- business information you choose or are required to provide
Payment providers may separately collect identity, banking, tax or verification information required to provide payment and payout services.
Fresh Collective may receive confirmation or status information from those providers without receiving all of the underlying information.
Gathering information
When you create, manage or book a Gathering, Fresh Collective may hold information such as:
- Gathering title
- date and time
- Creator
- Collective
- capacity
- booking information
- attendance information
- cancellation status
- Series information
- booking allowance usage
- location information
- venue information
- access instructions
Different Gathering information may have different visibility.
Public Gathering location information
Creators may provide general location information intended to help people discover a Gathering.
For example:
South Croydon, Victoria
This information may be publicly visible.
Private venue information
Creators may also provide more specific information intended only for eligible attendees or people managing a Gathering.
This may include:
- street address
- private venue name
- access instructions
- entry information
- other attendee-only details
Fresh Collective uses access controls intended to limit this information to the appropriate people.
You must not publicly redistribute private Gathering information without permission.
Booking and attendance information
When you book or attend a Gathering, we may collect information including:
- your booking
- booking status
- booking date
- attendance status
- whether you attended or were absent
- cancellations
- booking allowance usage
- other information needed to manage attendance
The Creator or people authorised to manage the relevant Gathering may be able to see this information.
Community Contributions
Fresh Collective may allow you to contribute information or content through community features.
This may include:
- posts
- comments
- replies
- reactions
- discussion content
- resources
- other contributions
The visibility of a Community Contribution depends on where you choose to share it.
For example, content may be visible to:
- the public
- Members of a Collective
- Members with particular access
- the people involved in a particular communication
You should understand the audience before posting.
Conversations
Collectives may provide community Conversation areas.
Information you contribute through Conversations may be visible to other people who have access to that Conversation area.
Depending on the Collective's settings, this may include:
- Members
- Members with active access
- Creators
- moderators
Fresh Collective may also access or review Conversation content where reasonably necessary for purposes such as:
- providing the service
- responding to reports
- moderation
- security
- investigating misuse
- legal compliance
Messages
Fresh Collective may allow Members to send private Messages to the people running their Collective.
People authorised to receive or manage those Messages may be able to see:
- your identity
- the content of the Message
- relevant conversation history
Fresh Collective may also access Message information where reasonably necessary for:
- platform operation
- support
- safety
- investigation of reported conduct
- security
- legal compliance
Messages should not be treated as a confidential professional service unless the relevant Creator expressly provides such a service and appropriate confidentiality arrangements apply.
Member directories
A Creator may choose to enable a Member directory within their Collective.
Where a directory is enabled, eligible Members may be able to see selected profile information about other Members of that Collective.
The information available depends on Fresh Collective's current directory features and Collective settings.
A Member directory is intended to support community connection.
Information obtained through a Member directory must not be used for unrelated purposes such as:
- scraping
- unsolicited marketing
- creating unrelated mailing lists
- harassment
- selling personal information
- unrelated commercial targeting
Information shared with Creators
When you join, purchase from or participate in a Collective, the Creator may need information about you in order to operate the Collective and provide what you requested.
Depending on the situation, a Creator may be able to access information such as:
- your name
- email address
- profile information
- membership status
- purchase information
- access information
- booking information
- attendance information
- Community Contributions
- Messages you send to them
- other information reasonably required to manage the Collective
Creators are required under the Creator Agreement to handle Member information responsibly.
Creators are responsible for their own use of information
Fresh Collective provides Creators with information for legitimate purposes associated with operating their Collectives.
If a Creator:
- exports Member information
- copies information outside Fresh Collective
- collects additional information independently
- communicates with Members outside Fresh Collective
- uses another service to collect information
the Creator is responsible for handling that information lawfully and appropriately.
A Creator may also have their own privacy obligations.
Fresh Collective is not responsible for an independent Creator's information-handling practices outside the Fresh Collective platform, except to the extent Fresh Collective has a legal responsibility in relation to those activities.
Information we collect automatically
When you use Fresh Collective, technical information may be created or collected automatically.
This may include:
- IP address
- device information
- browser information
- operating system
- timestamps
- page or feature requests
- error information
- security logs
- authentication information
- session information
- technical identifiers
- general usage information
This information may be used for purposes including:
- operating the platform
- authentication
- security
- fraud prevention
- troubleshooting
- performance monitoring
- understanding how features are functioning
- improving Fresh Collective
Cookies and similar technologies
Fresh Collective may use cookies, browser storage or similar technologies where necessary to provide platform functionality.
These technologies may be used for things such as:
- keeping you signed in
- authentication
- security
- remembering preferences
- maintaining sessions
- protecting the platform from misuse
If Fresh Collective introduces non-essential tracking, advertising or analytics technologies that require additional notice or consent, we will provide appropriate information and controls.
Information from other services
Fresh Collective may receive information from services we use to operate the platform.
For example, we may receive information from:
- Stripe about payments and payment status
- email providers about email delivery
- hosting or infrastructure providers about technical events
- security tools
- other services you choose to connect to Fresh Collective in the future
We only use information received from these services for purposes connected with Fresh Collective or as otherwise permitted by law.
Why we collect and use personal information
Fresh Collective may collect, hold, use or disclose personal information for purposes including:
- creating and managing accounts
- verifying accounts
- authenticating users
- operating Collectives
- managing memberships
- providing access to content and areas
- processing purchases
- managing subscriptions and payment plans
- processing refunds
- managing Creator payouts
- managing Gatherings and bookings
- recording attendance
- delivering Pathways and resources
- enabling Conversations and Messages
- enabling Member directories
- sending service communications
- providing customer support
- responding to complaints
- moderating communities
- preventing fraud
- maintaining security
- investigating misuse
- improving Fresh Collective
- troubleshooting technical issues
- keeping required business and financial records
- complying with legal obligations
- enforcing Fresh Collective's terms and policies
We may also use information for another purpose where:
- you would reasonably expect us to do so
- the purpose is related to the reason the information was collected
- you have consented
- the use is permitted or required by law
Service communications
Fresh Collective may use your contact information to send communications necessary to operate the services you use.
These may include:
- email verification
- welcome information
- security notices
- password reset emails
- purchase confirmations
- booking confirmations
- Gathering reminders
- cancellation notices
- payment notifications
- refund notifications
- important account information
- significant policy or platform notices
These are service communications rather than optional marketing.
Some service communications may be necessary for Fresh Collective to provide the service you have requested.
Marketing communications
Fresh Collective may separately send promotional or marketing communications where permitted by law.
Where required, we will:
- obtain appropriate consent
- identify Fresh Collective as the sender
- provide an unsubscribe option
You can unsubscribe from marketing communications without preventing Fresh Collective from sending service communications that are reasonably necessary to operate your account, bookings or purchases.
Creators who independently send promotional communications to Members are responsible for complying with applicable privacy and electronic marketing laws.
Who we may share personal information with
Fresh Collective does not sell personal information.
We may share personal information where reasonably necessary with the following kinds of recipients.
Creators
We may provide relevant information to the Creator or people authorised to manage a Collective you:
- join
- purchase from
- interact with
- book a Gathering through
The information shared depends on what is necessary for the relevant activity.
Other Members
Some Fresh Collective features are designed to share information between Members.
Examples may include:
- Member directories
- profile information
- Conversations
- Community Contributions
- reactions
- other community features
Information is shared according to the feature and relevant access settings.
Payment providers
We use payment providers, including Stripe, to process payments and related financial services.
Information necessary to:
- process payments
- administer subscriptions
- manage payment plans
- issue refunds
- resolve disputes
- facilitate Creator payouts
- prevent fraud
may be shared with the payment provider.
Email and communications providers
We currently use Resend to help deliver Fresh Collective emails.
Information provided to an email provider may include:
- name
- email address
- email content
- delivery information
- related technical information
only to the extent needed to provide the relevant communications service.
Hosting and infrastructure providers
Fresh Collective currently uses Render for application hosting, database and related infrastructure.
Fresh Collective data may therefore be processed or stored using systems operated by Render and its relevant service providers.
Professional advisers
We may disclose information where reasonably necessary to professional advisers such as:
- lawyers
- accountants
- auditors
- insurers
- security advisers
where they require the information to provide services to Fresh Collective.
Regulators, courts and authorities
We may disclose information where reasonably necessary or required by law, including to:
- courts
- tribunals
- regulators
- law enforcement
- government authorities
- other authorised bodies
We may also disclose information where reasonably necessary to establish, exercise or defend legal rights.
Business changes
If Fresh Collective is involved in a genuine:
- sale
- merger
- restructure
- financing
- transfer of business
- acquisition
personal information may be disclosed as reasonably necessary to consider or implement that transaction.
Where appropriate, reasonable steps will be taken to protect personal information during that process.
Public information
Some information on Fresh Collective is intentionally public.
This may include things such as:
- public Collective pages
- Creator names
- Creator profiles
- public Gathering information
- public Pathways
- public location information
- other information intentionally published publicly
Public content may be viewed without a Fresh Collective account.
It may also be:
- indexed by search engines
- linked from other websites
- shared by other people
- cached outside Fresh Collective
You should only make information public if you are comfortable with it being available beyond a private Collective audience.
Overseas storage and processing
Fresh Collective uses technology providers that operate internationally.
As a result, personal information may be stored, processed or disclosed outside Australia.
Current core providers include:
Render
Fresh Collective uses Render for hosting and infrastructure.
Render is a United States-based service and data may be processed in the United States.
Resend
Fresh Collective uses Resend to deliver email.
Resend and its authorised subprocessors currently use infrastructure and service providers located primarily in the United States.
Stripe
Fresh Collective uses Stripe for payment services.
Stripe operates internationally.
Information may be transferred to or processed in the United States and in other countries where Stripe, its affiliates or authorised subprocessors operate.
The countries and service providers used by technology platforms can change over time.
Fresh Collective will review this information periodically and update this Policy where there is a material change to our information-handling practices.
Protecting personal information
Fresh Collective takes reasonable steps to protect personal information from:
- misuse
- interference
- loss
- unauthorised access
- unauthorised modification
- unauthorised disclosure
Our protections may include measures such as:
- access controls
- authentication
- permission-based access
- technical security controls
- protected hosting infrastructure
- secure communication protocols
- monitoring and logging
- restricted administrative access
- software and infrastructure maintenance
- security testing
- backups and recovery measures
No internet-based service can guarantee absolute security.
If you believe your Fresh Collective account or information may have been compromised, please contact us promptly.
Data breaches
If Fresh Collective becomes aware of a data or security incident involving personal information, we will investigate and respond according to the circumstances.
Where required by law, we will:
- assess whether a notifiable data breach has occurred
- notify affected people
- notify the relevant regulator
- take reasonable steps to reduce the risk of harm
We may also communicate about an incident where notification is appropriate even if it is not legally required.
How long we keep information
Fresh Collective does not keep every type of personal information forever.
How long information is retained depends on:
- why it was collected
- whether your account remains active
- whether the information is needed to provide ongoing access
- transaction and accounting requirements
- payment disputes
- safety or moderation records
- security requirements
- legal obligations
- limitation periods
- backup and recovery processes
For example, information relating to a financial transaction may need to be retained after an account is closed.
Where personal information is no longer reasonably required and Fresh Collective is not required or permitted to retain it, we may delete, de-identify or otherwise securely dispose of it.
Closing your account
You may request closure of your Fresh Collective account.
Account closure may remove or deactivate access to the platform.
However, closing an account does not necessarily mean every record associated with you can be immediately deleted.
Fresh Collective may need to retain information for purposes including:
- completed transactions
- financial records
- refunds
- payment disputes
- fraud prevention
- legal obligations
- security
- complaints
- legitimate record keeping
Your previous Community Contributions may also not necessarily disappear automatically from every community context when your account closes.
If you have a particular concern about content you have contributed, you can contact Fresh Collective.
Accessing your personal information
You may be able to view or update some personal information directly through your Fresh Collective account.
You may also contact us to request access to personal information Fresh Collective holds about you.
We may need to verify your identity before providing access.
In some circumstances, access may be limited or refused where permitted or required by law.
If that happens, we will explain the reason where we are legally able to do so.
Correcting your information
We want the personal information Fresh Collective holds to be accurate and reasonably current.
You may be able to correct some information directly through your account.
You can also contact us if you believe personal information we hold about you is:
- inaccurate
- out of date
- incomplete
- irrelevant
- misleading
We will consider reasonable correction requests and take appropriate action.
Deleting or removing information
You may request that Fresh Collective delete or remove certain personal information.
Whether we can do so will depend on matters including:
- whether the information is still required to provide a service
- whether it forms part of a financial or legal record
- whether another person's rights are affected
- whether we are required or permitted to retain it
- whether the information remains necessary for security, dispute or moderation purposes
Where information cannot be deleted, we may be able to restrict, de-identify or otherwise limit its use where appropriate.
Information about other people
You must respect other people's privacy when using Fresh Collective.
Do not provide another person's personal information unless you have an appropriate reason and authority to do so.
In particular, you must not:
- publish another person's private information without permission
- scrape Member information
- collect personal information for unrelated purposes
- use Member details to create unrelated marketing lists
- sell another person's personal information
- use information to harass or exploit another person
The Community Guidelines and Terms of Use contain additional rules relating to privacy and community conduct.
If you provide information about another person
Sometimes you may legitimately provide information relating to another person.
For example, this may occur:
- when reporting misconduct
- when contacting support
- when responding to a complaint
- when managing a Collective
You should only provide information that is reasonably relevant to the purpose.
Fresh Collective will handle that information according to this Policy and applicable law.
People under 18
Fresh Collective is an 18+ platform.
We do not knowingly permit people under 18 to create Fresh Collective accounts or participate as Members or Creators.
If we become aware that an account is being used by a person under 18, we may:
- restrict the account
- close the account
- take reasonable steps to remove information where appropriate
subject to any legal, security or record-keeping requirements that require information to be retained.
If you believe a person under 18 is using Fresh Collective, please contact us.
External websites and Creator services
Fresh Collective may include links to:
- Creator websites
- external booking or resource services
- video services
- social media
- other third-party services
Those services may collect personal information independently of Fresh Collective.
Their information-handling practices are governed by their own privacy policies and terms.
Fresh Collective's Privacy Policy does not control independent third-party websites or services.
Creator collection outside Fresh Collective
A Creator may sometimes need information that Fresh Collective does not collect.
For example, a Creator operating a physical activity may separately collect:
- health screening information
- emergency information
- participation waivers
- informed consent
- professional intake information
Where a Creator independently collects this information outside Fresh Collective, the Creator is responsible for:
- explaining what is being collected
- collecting it lawfully
- protecting it appropriately
- meeting any applicable privacy obligations
Fresh Collective should not be used as a general-purpose medical records system.
Anonymous and aggregated information
Fresh Collective may create or use information that has been aggregated or de-identified so that it no longer reasonably identifies an individual.
This may be used for purposes such as:
- understanding platform activity
- improving features
- business planning
- reporting
- troubleshooting
- understanding community or product trends
This Policy does not restrict the use of information that is no longer personal information under applicable law.
Privacy complaints
If you believe Fresh Collective has mishandled your personal information, please contact us.
Please provide enough information to help us understand:
- what happened
- what information is involved
- what your concern is
- what outcome you are seeking
Fresh Collective will:
- acknowledge and review the complaint
- investigate the relevant circumstances
- seek further information where reasonably necessary
- provide a response within a reasonable period
- take appropriate corrective action where warranted
We encourage you to raise the issue with us first so we have an opportunity to understand and address it.
External privacy complaints
Where the Privacy Act 1988 (Cth) applies to Fresh Collective and you are not satisfied with how we have handled a privacy complaint, you may be able to contact the:
Office of the Australian Information Commissioner (OAIC)
Information about privacy rights and complaints is available through the OAIC.
Nothing in this Policy prevents you from exercising any privacy or consumer rights available to you under applicable law.
Changes to this Privacy Policy
Fresh Collective will continue to evolve.
We may update this Privacy Policy where necessary to reflect:
- new platform features
- changes to information we collect
- changes to service providers
- changes to how information is used
- legal or regulatory changes
- improvements to Fresh Collective's privacy practices
The current version will always be made available through Fresh Collective.
Where a change materially affects how personal information is handled, we will provide reasonable notice where appropriate.
We will not use a revised Privacy Policy as a basis to retrospectively justify a materially different use of personal information where additional consent or another legal basis would be required.
