Fresh Collective — Payment, Refund & Cancellation Policy
Version 1.0
This Policy explains how payments, payment plans, subscriptions, refunds and cancellations work within Fresh Collective.
It should be read alongside the Terms of Use, Membership Terms, Creator Agreement and any specific terms shown when you make a purchase.
Fresh Collective is for people aged 18 years and over.
Why this Policy exists
Fresh Collective is home to independent Collectives created and managed by Creators.
Creators decide what they offer, how much it costs and, within the requirements of Australian law, the refund and cancellation terms that apply to their offerings.
Fresh Collective provides the platform and payment infrastructure that allows these purchases to take place.
This Policy explains:
- the different ways payments may be structured
- what you are agreeing to when you make a purchase
- how subscriptions and payment plans work
- what happens if a payment fails
- how refunds and cancellations are handled
- the responsibilities of Members, Creators and Fresh Collective
Nothing in this Policy excludes or limits rights that cannot lawfully be excluded, including rights under the Australian Consumer Law.
What this Policy covers
This Policy may apply to payments for:
- Collective memberships
- access to Pathways
- Gathering bookings
- Gathering Series
- courses, programs and experiences
- one-off purchases
- fixed payment plans
- ongoing subscriptions
- Creator subscriptions or plans
- other paid offerings made available through Fresh Collective
The exact inclusions, access period, price and payment structure will be shown before you complete a purchase.
How payments work
Payments made through Fresh Collective are processed using our payment provider.
Fresh Collective does not store your complete payment card or banking details.
Depending on the offering, a payment may be made as:
- a one-off payment
- an ongoing subscription
- a fixed payment plan
These are different payment arrangements.
The payment structure that applies to your purchase will be shown before you confirm it.
One-off payments
A one-off payment is a single payment for the offering described at the time of purchase.
Examples may include:
- a single Gathering
- a workshop
- a course
- a defined period of access
- another one-time offering
Once the payment has been successfully processed, the access or booking included with that purchase will be granted in accordance with the offer.
Ongoing subscriptions
A subscription is a recurring payment that continues until it is cancelled, unless the subscription has a stated end date.
Before starting a subscription, you should be shown:
- the amount charged
- how often you will be charged
- what the subscription includes
- when recurring payments begin
- how the subscription can be cancelled
By starting a subscription, you authorise the relevant recurring payments to be charged to your nominated payment method until the subscription is cancelled or otherwise ends.
Cancelling a subscription prevents future renewals.
Unless otherwise stated, access already paid for will generally continue until the end of the current paid billing period.
A cancellation does not ordinarily create a refund for time that has already been used or made available, except where a refund is required by law or provided under the applicable refund policy.
Fixed payment plans
A fixed payment plan allows the total price of an offering to be paid through a defined number of instalments.
For example:
$37.80 per week for 10 weeks Total commitment: $378.00
A fixed payment plan is not the same as an ongoing subscription.
When you choose a fixed payment plan, you are agreeing to the total purchase price and authorising the scheduled instalments described before purchase.
Before confirming a payment plan, you should be shown:
- the total purchase price
- the amount of each instalment
- how often instalments will be charged
- the total number of instalments
- what the purchase includes
Unless the purchase terms state otherwise, cancelling your participation, leaving a Collective or choosing not to use the remaining services does not automatically cancel instalments that form part of an agreed fixed payment plan.
This does not affect any rights you may have under Australian Consumer Law or any cancellation or refund rights offered by the Creator.
If an offering itself is cancelled or cannot be provided, the remaining payment obligations and any appropriate refund, credit or other remedy will be considered in accordance with this Policy and applicable law.
Pricing
Creators are responsible for setting the prices of their offerings.
Before you confirm a purchase, Fresh Collective aims to clearly show the information relevant to that purchase, including:
- the price
- whether payment is one-off, recurring or by instalments
- the payment frequency
- the number of instalments, where applicable
- the total financial commitment for a fixed payment plan
- what the purchase includes
- any mandatory charges collected through the platform
Where taxes or other charges are required to be included by law, they will form part of the displayed price.
Optional purchases or extras are separate unless clearly stated as included.
What your purchase gives you
A purchase may provide one or more forms of access.
For example, a purchase may include:
- membership of a Collective
- access to a Gathering or Gathering Series
- access to a Pathway
- access to resources
- a booking allowance
- access for a specified period
- another benefit described in the offer
The specific inclusions will be shown as part of the purchase.
Membership and paid access are not always the same thing
Some purchases may automatically make you a Member of a Collective.
Your Collective membership may continue even after a particular period of paid access ends.
For example, you might remain a Member of a Collective while no longer having active access to a particular Pathway, Gathering Series or paid area.
The Creator's Collective settings and the terms of the particular purchase determine what remains available to you.
Authorising payments
When you provide a payment method and confirm a purchase, you authorise the payment provider to charge that payment method in accordance with the payment arrangement you selected.
For:
- a one-off purchase, this means the stated one-off amount
- a subscription, this means recurring payments until cancellation or the subscription otherwise ends
- a fixed payment plan, this means the stated instalments forming part of the agreed total purchase price
You are responsible for ensuring your payment details remain current and that you are authorised to use the payment method provided.
Payment failures
Sometimes a payment cannot be successfully processed.
This may happen because:
- a card has expired
- insufficient funds are available
- a bank declines the transaction
- payment details have changed
- another payment-processing issue occurs
If a payment fails:
- you may be notified
- you may be asked to update your payment details
- the purchase may not become active
- access to paid content or experiences may be suspended or restricted
- a payment schedule may be cancelled where the purchase cannot successfully commence
The effect of a failed payment depends on the type of purchase and when the failure occurs.
A failed payment does not create access to an offering that has not been successfully paid for.
Where a payment relates to an existing fixed payment plan, any ongoing rights or obligations will depend on the purchase terms, the circumstances of the failure and applicable law.
Cancelling a subscription
You may cancel an ongoing subscription through the account or platform controls made available for that subscription.
Once cancelled:
- future renewals will stop
- no new subscription period will begin
- access will generally continue until the end of the period already paid for, unless otherwise stated
Deleting your account or leaving a Collective is not a substitute for cancelling an active subscription.
You should cancel the subscription itself where a separate cancellation control is provided.
Cancelling a fixed payment plan
A fixed payment plan represents an agreement to pay a defined total purchase price in instalments.
It is therefore different from cancelling an ongoing subscription.
Unless otherwise stated in the offer, cancelling your participation does not automatically remove the remaining payment commitment.
However, a Creator may offer additional cancellation rights, and your rights under Australian Consumer Law continue to apply.
If circumstances mean that an offering can no longer be provided, remaining instalments may be cancelled and a refund, credit or other remedy may be provided where appropriate.
Refunds
Each Creator is responsible for clearly communicating any additional refund or change-of-mind policy that applies to their offerings.
A Creator may choose to offer refunds or credits in circumstances such as:
- change of mind
- inability to attend
- cancellation within a specified period
- transfer to another Gathering
- another circumstance determined by the Creator
These additional policies must not remove rights provided by law.
Australian Consumer Law
Nothing in a Creator's refund policy, this Policy or any other Fresh Collective document excludes rights or remedies that cannot lawfully be excluded.
Australian Consumer Law provides consumer guarantees that may apply when goods or services are purchased.
Depending on the circumstances, these may include rights to:
- have a problem remedied
- cancel a service
- receive a partial or full refund
- receive another remedy required by law
A statement such as "no refunds" does not remove rights that exist under Australian Consumer Law.
Change of mind alone does not necessarily create a legal entitlement to a refund unless the Creator has offered a change-of-mind policy or another legal right applies.
How refunds are processed
Where a refund is approved through Fresh Collective, it will generally be processed through the payment method used for the original transaction where possible.
The time taken for funds to appear in your account may depend on:
- the payment provider
- your bank or financial institution
- the payment method used
A refund may be:
- full
- partial
- associated with cancellation of future payments
- accompanied by changes to the access granted by the original purchase
Where a refund removes the basis for paid access, the related paid access may also end.
This does not necessarily mean that the person's underlying Collective membership will end.
Gathering cancellations and changes
Creators are responsible for managing Gatherings they offer through their Collectives.
Sometimes a Creator may need to:
- cancel a Gathering
- change the date or time
- change the location
- reschedule an experience
- make another material change
Creators should communicate significant changes to affected Members as soon as reasonably possible.
Depending on the circumstances, an affected Member may be offered:
- a replacement Gathering
- rescheduling
- a credit
- transfer to another session
- a partial refund
- a full refund
- another appropriate
