Fresh Collective — Membership Terms

Version 1.0

These Membership Terms explain what it means to be a Member of a Collective within Fresh Collective.

They form part of the Terms of Use and should be read alongside the Community Guidelines, Privacy Policy, Payment, Refund & Cancellation Policy, and any terms that apply to a particular purchase or experience.

Fresh Collective is for people aged 18 years and over.


Why these Terms exist

Fresh Collective exists to help people find communities where they can learn, connect, participate and belong.

Every Collective is created and led by a Creator, while Fresh Collective provides the platform that allows those communities to operate.

These Terms explain:

  • how Collective membership works
  • the difference between membership and paid access
  • how access to different parts of a Collective may be managed
  • the responsibilities Members share
  • how purchases may affect membership
  • what happens when membership or access ends
  • the respective roles of Members, Creators and Fresh Collective

Becoming a Member

A Member is a person who has joined one or more Collectives within Fresh Collective.

Depending on the Collective, membership may begin in different ways.

For example, you may become a Member by:

  • joining a Collective that is free to join
  • making a qualifying purchase
  • accepting an invitation
  • being added through functionality made available to a Creator
  • another joining process made available through Fresh Collective

The way membership works may differ between Collectives.


Age requirement

You must be at least 18 years old to create an account or participate in Fresh Collective.

By creating an account, joining a Collective or making a purchase through Fresh Collective, you confirm that you are 18 years of age or older.

Fresh Collective is not designed for children or for accounts operated on behalf of children.


Membership is personal to you

Your Fresh Collective account and Collective memberships belong to you.

You are responsible for:

  • providing accurate account information
  • keeping your login details secure
  • keeping important contact information up to date
  • ensuring information you provide through the platform is accurate
  • managing your memberships and purchases
  • complying with these Terms and the Community Guidelines

You must not allow another person to use your account as if it were their own.

If you believe someone has accessed your account without permission, you should contact Fresh Collective as soon as reasonably possible.


Membership and access are different things

Being a Member of a Collective does not necessarily mean that every area, resource or experience within that Collective is available to you.

This distinction is important.

Collective membership

Membership represents your ongoing relationship with a Collective.

Depending on the Collective, being a Member may allow you to access things such as:

  • the Collective Home
  • community areas
  • Conversations
  • Messages
  • member-only information
  • other areas made available to Members

Active access

Some experiences or areas may require additional active access.

Active access may come from:

  • purchasing an eligible offering
  • holding a current subscription
  • receiving access through a payment option
  • being granted access by a Creator
  • another access arrangement made available through the Collective

For example, you may remain a Member of a Collective after access to a particular term, Pathway, program or paid experience has ended.

Your membership can therefore remain active even when a particular paid entitlement has expired.


Access to different areas of a Collective

Creators can decide who may access certain areas of their Collective.

Depending on the area, access may be available to:

  • everyone
  • Members
  • Members with active access

Some areas may always have a particular level of access because of how Fresh Collective operates.

As a result, two Members of the same Collective may not always see exactly the same content or navigation.

Your access may depend on:

  • whether you are a Member
  • whether you hold current active access
  • the purchase or entitlement you hold
  • the Collective's access settings
  • whether particular content is currently available

Having access to one part of a Collective does not automatically give you access to every other part.


Free-to-join Collectives

Some Collectives are free to join.

If a Collective is free to join, you may become a Member without making a purchase.

This does not necessarily mean that everything inside the Collective is free.

A Creator may separately offer:

  • paid Gatherings
  • paid Pathways
  • programs
  • courses
  • resources
  • subscriptions
  • other paid experiences

Any price and purchase conditions should be shown before you buy.


Purchase-required Collectives

Some Collectives require a qualifying purchase before membership is granted.

Where this applies, the available joining options will be shown before you purchase.

A qualifying purchase may provide:

  • Collective membership
  • access to a particular program or term
  • Pathway access
  • Gathering access
  • booking allowances
  • resources
  • other inclusions described in the offer

Different joining options may include different levels of access.

Making a qualifying purchase may create your Collective membership automatically.

If the paid access associated with that purchase later expires, your underlying Collective membership may continue unless the Creator's settings or another applicable rule provides otherwise.


Purchases and payment commitments

Some Collective experiences require payment.

Payments may include:

  • one-off purchases
  • ongoing subscriptions
  • fixed payment plans

The Payment, Refund & Cancellation Policy explains how these different payment arrangements work.

Joining or leaving a Collective does not automatically cancel an existing financial commitment.

For example:

  • leaving a Collective does not automatically cancel an ongoing subscription
  • leaving a Collective does not automatically cancel remaining instalments in a fixed payment plan
  • closing your Fresh Collective account does not necessarily remove an existing payment obligation

You should manage payment arrangements separately where required.

Nothing in these Terms limits rights that cannot lawfully be excluded, including rights under Australian Consumer Law.


Booking allowances and participation limits

Some purchases may include a booking allowance.

For example, an offering may allow you to attend:

  • one Gathering each week
  • two Gatherings each week
  • a specified number of Gatherings during a Series
  • another defined number of sessions or experiences

The allowance that applies to your purchase will be described as part of the offer.

Membership itself does not create a right to exceed the booking allowance associated with your purchase.

Booking availability may also depend on:

  • Gathering capacity
  • booking windows
  • availability
  • the dates covered by your access
  • other conditions described in the offering

As a Member, you agree to participate responsibly

Fresh Collective is designed around meaningful participation rather than passive consumption.

You are not required to participate constantly, but when you do participate, you agree to do so respectfully.

This includes:

  • treating other people with respect
  • participating in good faith
  • respecting different experiences and perspectives
  • following the Community Guidelines
  • respecting the culture and purpose of each Collective
  • respecting reasonable boundaries set by Creators
  • communicating honestly
  • avoiding behaviour that harms or disrupts the community

You do not have to agree with everyone.

Constructive disagreement, curiosity and thoughtful discussion are welcome.

The way disagreement is expressed matters.


Respect the Creator's work

Creators invest time, care, skill and creativity into their Collectives.

Unless a Creator clearly gives permission otherwise, you must not:

  • reproduce Creator Content
  • redistribute paid resources
  • share private Collective material publicly
  • give another person access to content they have not been granted access to
  • record or redistribute Gatherings without permission
  • use Creator Content commercially without permission
  • present another Creator's work as your own

Purchasing access to content does not transfer ownership of that content to you.

You receive the right to access and use the material in the way described by the Creator and the relevant purchase.


Community Contributions

Members may be able to contribute content within Fresh Collective.

Depending on the features available, Community Contributions may include:

  • posts
  • comments
  • replies
  • reactions
  • discussion content
  • shared resources
  • profile information
  • other material contributed to community areas

You remain responsible for what you contribute.

You should only share material that:

  • you have the right to share
  • is consistent with the Community Guidelines
  • respects the privacy of other people
  • is appropriate for the community in which it is shared

Do not post another person's confidential or private information without appropriate permission.

Community Contributions may be moderated by Creators or Fresh Collective in accordance with the Community Guidelines and Terms of Use.


Privacy within Collectives

Collectives may involve conversations, relationships and shared experiences.

Members are expected to respect the privacy of others.

You agree not to:

  • share private Collective discussions publicly without appropriate permission
  • disclose another Member's personal information without permission
  • copy or distribute private messages without a legitimate reason
  • use information obtained through a Collective to harass, target or exploit another person

This does not prevent someone from:

  • seeking help
  • reporting misconduct
  • obtaining professional advice
  • exercising a legal right
  • making a disclosure required or permitted by law

The Privacy Policy explains how Fresh Collective handles personal information.


Member directories and profiles

Some Collectives may make a Member directory available to Members.

Where a Member directory is enabled, certain profile information may be visible to other eligible Members of that Collective.

Creators can control whether the Member directory is available within their Collective.

Fresh Collective may also use profile information to support platform features such as:

  • community participation
  • recognition of shared Collective membership
  • messaging or connection features
  • attribution of Community Contributions

The information displayed will depend on the platform settings and features available at the time.


Conversations and Messages

Some Collectives may provide access to Conversations, Messages or other communication features.

These features have different purposes.

For example:

  • Conversations may support community discussion between Members
  • Messages may allow Members to communicate privately with the people running their Collective

Access depends on the Collective's settings and your membership or access status.

You must use communication features consistently with the Community Guidelines.

Fresh Collective does not guarantee that another Member or Creator will respond to a message within a particular period.


Gatherings

Gatherings are experiences organised by Creators.

They may take place:

  • in person
  • online
  • live
  • as part of a Series
  • in another format described by the Creator

Gatherings may have:

  • capacity limits
  • booking requirements
  • attendance requirements
  • location information
  • access instructions
  • specific participation conditions

You are responsible for reviewing the information provided about a Gathering before choosing to participate.


Private Gathering information

Some information about a Gathering may only be made available to people who have a confirmed booking or who are responsible for managing the Gathering.

This may include information such as:

  • a specific street address
  • private venue details
  • access instructions
  • other information intended only for attendees

You must not publicly redistribute private Gathering information without permission.

Public-facing location information may be intentionally less specific.


Attending Gatherings

When attending a Gathering, you agree to:

  • follow reasonable instructions given by the Creator or facilitator
  • behave respectfully toward other participants
  • follow venue requirements
  • take reasonable care for your own safety and the safety of others
  • comply with any activity-specific conditions communicated before participation

Some activities may require additional agreements, waivers, health information or participation conditions.

These may be provided separately by the Creator where relevant.


Creator responsibilities

Creators are responsible for leading and managing their Collectives.

This may include:

  • determining the purpose and culture of the Collective
  • creating and managing content
  • setting Collective access arrangements
  • setting prices
  • managing Gatherings
  • communicating with Members
  • moderating community participation
  • managing Member access within the tools provided by Fresh Collective
  • complying with applicable laws and Fresh Collective requirements

Creators are expected to communicate material information about their offerings clearly.

The Creator Agreement explains Creator responsibilities in more detail.


Creator moderation

Creators may moderate participation within their own Collectives.

Depending on the circumstances, a Creator may:

  • communicate with a Member about behaviour
  • remove Community Contributions
  • limit participation
  • restrict access to certain community areas
  • suspend participation
  • remove a Member from their Collective

Creator moderation must remain consistent with Fresh Collective's Terms of Use, Community Guidelines and applicable law.

Where a Member has made a payment, removal from a Collective does not automatically determine whether a refund is payable.

Payment and refund rights are considered separately under:

  • the applicable purchase terms
  • the Payment, Refund & Cancellation Policy
  • Australian Consumer Law
  • other applicable law

Fresh Collective moderation

Fresh Collective may take action where activity on the platform:

  • breaches the Terms of Use
  • breaches the Community Guidelines
  • creates a safety or security concern
  • involves misuse of the platform
  • appears unlawful
  • threatens the integrity of Fresh Collective or its communities

Depending on the circumstances, Fresh Collective may:

  • remove content
  • restrict functionality
  • limit access
  • suspend an account
  • close an account
  • take other reasonable action

Serious matters may result in immediate action without requiring earlier moderation steps.


Leaving a Collective

You may choose to leave a Collective.

Leaving a Collective may cause access to Member-only areas to end.

This may include access to:

  • Collective Home
  • Conversations
  • Messages
  • the Member directory
  • other Member-only areas

Leaving does not necessarily:

  • cancel a subscription
  • cancel a fixed payment plan
  • remove an existing financial obligation
  • create a refund
  • cancel a separate purchase

Payment arrangements should be managed separately where required.

If you later rejoin, previous access, Community Contributions or purchase history may not necessarily be restored in exactly the same form.


If your paid access ends

Paid access may end because:

  • an access period expires
  • a program or term ends
  • a subscription ends
  • a payment arrangement ends
  • access is refunded or reversed
  • another condition of the purchase is no longer met

When paid access ends:

  • access to associated paid content may end
  • areas requiring active access may no longer be visible
  • booking allowances may end
  • future bookings may be affected where the underlying access is no longer valid

Your underlying Collective membership may continue.

This means you may still be able to access areas that are available to Members generally.


If a Creator closes a Collective

A Creator may decide to stop operating a Collective.

If this happens, Fresh Collective and/or the Creator may communicate with affected Members about what will happen next.

Depending on the circumstances:

  • new memberships may close
  • new purchases may stop
  • community participation may end
  • access to Collective areas may be withdrawn
  • future Gatherings may be cancelled
  • existing purchases may need to be completed, refunded, credited or otherwise resolved

Existing financial commitments and consumer rights must be dealt with appropriately.

Closing a Collective does not remove rights that Members have under applicable law.


If a Creator leaves Fresh Collective

A Creator may stop using Fresh Collective or cease operating through the platform.

Fresh Collective does not guarantee that every Creator or Collective will remain available indefinitely.

Where a Creator's departure affects an existing paid commitment, Fresh Collective may work with the Creator and affected Members to determine an appropriate outcome.

This may include, where appropriate:

  • continued access for a limited period
  • cancellation of future payments
  • refunds
  • credits
  • another suitable arrangement

The appropriate outcome will depend on the circumstances and applicable law.


Closing your Fresh Collective account

You may request to close your Fresh Collective account.

Before doing so, you should review any:

  • active subscriptions
  • fixed payment plans
  • future bookings
  • pending refunds
  • unresolved transactions
  • Creator or Member responsibilities associated with the account

Closing your account does not automatically remove financial or legal obligations that arose before closure.

Some information may need to be retained after account closure where required or permitted by law, as explained in the Privacy Policy.


Platform availability

Fresh Collective aims to provide a reliable platform, but online services can occasionally be interrupted.

Features may be:

  • changed
  • improved
  • replaced
  • temporarily unavailable
  • discontinued

Fresh Collective will aim to manage significant changes reasonably and to avoid unnecessarily disrupting existing Member access or purchases.

Where a platform change materially affects something you have paid for, your rights will be considered in accordance with the applicable purchase terms, the Payment, Refund & Cancellation Policy and applicable law.


Working together

Fresh Collective works through three connected roles.

Platform Owner

Fresh Collective provides and operates the platform.

This includes the infrastructure that allows Creators and Members to participate, communicate, purchase access and manage their accounts.

Creators

Creators build and lead Collectives.

They decide what experiences to create and shape the culture of their communities within Fresh Collective's shared rules.

Members

Members bring Collectives to life.

They participate, learn, contribute, connect and help create the culture of the communities they join.

Each role is different.

Each has responsibilities.

Fresh Collective works best when those responsibilities are understood and respected.


Other terms that apply

These Membership Terms are part of Fresh Collective's broader governance framework.

Depending on how you use the platform, the following may also apply:

  • Terms of Use
  • Privacy Policy
  • Community Guidelines
  • Payment, Refund & Cancellation Policy
  • terms displayed for a particular purchase
  • activity-specific conditions provided by a Creator

If you also become a Creator, the Creator Agreement will apply to your activity as a Creator.

Nothing in these documents excludes rights or remedies that cannot lawfully be excluded.


Changes to these Terms

Fresh Collective may update these Membership Terms as the platform evolves.

Changes may be made to reflect:

  • new platform features
  • changes to how Collectives operate
  • legal or regulatory requirements
  • improvements to Fresh Collective's governance framework

Where a change is significant, Fresh Collective will provide appropriate notice where reasonably practicable.

An update to these Terms will not retrospectively change the agreed price, payment schedule or essential financial terms of an existing purchase unless:

  • you agree to the change, or
  • the change is permitted or required by law.

The current published version will always be available through the World Guide.
