Creator Agreement

Fresh Collective — Creator Agreement

Version 1.0

This Creator Agreement applies when you create, operate or manage a Collective through Fresh Collective.

It forms part of the Terms of Use and should be read alongside the Community Guidelines, Privacy Policy, Payment, Refund & Cancellation Policy, and any Fresh Collective Creator plan or other terms that apply to your use of the platform.

Fresh Collective is for people aged 18 years and over.


Why this Agreement exists

Fresh Collective believes meaningful communities are created by people, not platforms.

Creators bring those communities to life.

Fresh Collective provides the infrastructure that allows Creators to:

  • create and manage Collectives
  • share content and resources
  • create Pathways
  • host Gatherings
  • communicate with Members
  • offer free and paid experiences
  • manage memberships and access
  • receive payments
  • build communities around meaningful work

This Agreement explains the responsibilities Fresh Collective and Creators each take on when a Creator builds and manages a Collective through the platform.


What this Agreement covers

This Agreement applies to your activity as a Creator within Fresh Collective.

It covers matters including:

  • creating and managing a Collective
  • Creator responsibilities
  • content and intellectual property
  • Gatherings and experiences
  • membership and access
  • payments and pricing
  • refunds and cancellations
  • payment plans and subscriptions
  • Creator plans and platform fees
  • payouts
  • Member information and privacy
  • community moderation
  • safety and legal compliance
  • closing or leaving a Collective

If you also participate in Fresh Collective as a Member, the Membership Terms apply to your activity as a Member.


Becoming a Creator

You must be at least 18 years old to become a Creator.

By creating or operating a Collective, you confirm that:

  • you are 18 years of age or older
  • the information you provide is accurate
  • you are legally able to enter into this Agreement
  • where you act on behalf of a business or organisation, you are authorised to do so

Creators may operate as individuals, sole traders, companies, organisations or other lawful business structures.

You are responsible for determining the legal and business structure appropriate to your activities.


The role of a Creator

A Creator builds and manages one or more Collectives within Fresh Collective.

Creators decide what they want to create and who they want to serve.

Depending on the Collective, this may include:

  • communities
  • Gatherings
  • programs
  • classes
  • courses
  • Pathways
  • resources
  • discussions
  • memberships
  • subscriptions
  • paid experiences
  • other offerings supported by Fresh Collective

Fresh Collective does not direct the substance of a Creator's work.

Creators remain responsible for the experiences, services, content and communities they create.


Independent Creators

Creators operate independently.

Nothing in this Agreement creates an employment relationship between a Creator and Fresh Collective.

Unless expressly agreed otherwise, nothing in this Agreement creates:

  • an employer and employee relationship
  • a partnership
  • a joint venture
  • a franchise
  • authority for a Creator to make commitments on behalf of Fresh Collective

Creators are responsible for their own business activities, including any registrations, licences, insurance, taxation and professional obligations that apply to them.

Fresh Collective provides the platform through which Creator activities may be offered and managed.


Creating a Collective

Every Collective should have a genuine purpose.

When creating and operating a Collective, you agree to provide information that is:

  • accurate
  • reasonably current
  • not misleading
  • appropriate for the audience
  • consistent with the Community Guidelines
  • consistent with applicable law

This includes information about:

  • what the Collective is
  • who it is for
  • what Members can expect
  • what paid offerings include
  • prices
  • access conditions
  • Gathering details
  • Creator qualifications where relevant
  • other information that may materially influence someone's decision to join or purchase

You must not make claims about your Collective, services or experiences that you know are false or misleading.


Creators shape places, not audiences

A Collective is more than a distribution channel for content.

Creators are expected to build communities where people can participate, contribute, learn and connect.

Every Collective will be different.

Fresh Collective does not require every Creator to use the same:

  • format
  • teaching style
  • community structure
  • pricing model
  • participation model
  • Gathering format

Creators have significant freedom to shape their own Collective, provided they operate within:

  • this Agreement
  • the Terms of Use
  • the Community Guidelines
  • applicable law
  • the technical capabilities of Fresh Collective

Creator Content

Creator Content means material you create or provide as part of your Creator activity.

This may include:

  • text
  • images
  • videos
  • audio
  • resources
  • exercises
  • worksheets
  • courses
  • Pathways
  • Gathering descriptions
  • branding
  • logos
  • educational material
  • other original content

You keep ownership of your Creator Content

Fresh Collective does not take ownership of your Creator Content simply because you upload or publish it through the platform.

You retain any intellectual property rights you hold in that content.


Permission to operate the platform

To provide Fresh Collective's services, you give Fresh Collective a non-exclusive licence to:

  • host
  • store
  • reproduce
  • display
  • format
  • technically process
  • distribute through the platform
  • make available to authorised users

your Creator Content where reasonably necessary to operate Fresh Collective and provide your Collective to Members.

Where you make content publicly visible, this licence also allows Fresh Collective to display that content on public Fresh Collective surfaces.

This licence lasts for as long as the content needs to be available through Fresh Collective, subject to reasonable backup, record-keeping and legal retention requirements.

You continue to own your Creator Content.


Promotion of your Collective

Fresh Collective may display publicly available information about your Collective in Fresh Collective discovery, promotional or navigation features.

This may include:

  • Collective name
  • Creator name
  • public imagery
  • Collective description
  • public Gathering information
  • public Pathway information
  • public location information
  • other content you have chosen to make public

Fresh Collective will not treat private Member or attendee information as promotional content.


You must have the right to use what you upload

You are responsible for ensuring you have appropriate rights or permissions for material you provide through Fresh Collective.

You must not knowingly upload or publish content that:

  • infringes copyright
  • infringes trademarks or other intellectual property
  • breaches confidentiality
  • unlawfully uses another person's image or personal information
  • is defamatory
  • is unlawful
  • otherwise violates another person's rights

If content belongs to someone else, you must have permission or another lawful basis to use it.


Community Contributions

Members may contribute content within your Collective.

These Community Contributions may include:

  • posts
  • comments
  • replies
  • reactions
  • shared resources
  • discussion content
  • other community participation

Members remain responsible for their own Community Contributions.

Creators may moderate Community Contributions in accordance with the Community Guidelines and the moderation tools provided by Fresh Collective.

You do not automatically become the owner of material contributed by Members.


Membership settings

Creators can determine how people become Members of their Collective using the options provided by Fresh Collective.

Depending on available platform functionality, this may include:

  • free-to-join membership
  • purchase-required membership
  • invitation or Creator-managed membership
  • other supported joining models

You are responsible for choosing settings that accurately reflect how your Collective operates.


Membership and active access

Collective membership and access to paid experiences are not necessarily the same thing.

A person may remain a Member of your Collective while no longer having active access to a particular:

  • Pathway
  • program
  • term
  • Gathering Series
  • paid area
  • other offering

Creators should structure offerings and communicate them clearly so Members can understand:

  • what membership provides
  • what requires an additional purchase
  • how long paid access lasts
  • what happens when that access expires

Collective area access

Fresh Collective may allow Creators to determine who can access particular areas of a Collective.

Depending on the feature, access may be available to:

  • everyone
  • Members
  • Members with active access

Some areas may have access rules set by Fresh Collective because of how the platform operates.

Creators are responsible for selecting access settings appropriate to their Collective.

You should not rely on hiding a navigation link as a substitute for protecting confidential or highly sensitive information.

Only information appropriate for the intended audience should be placed within a particular Collective area.


Member directories

Creators may be able to enable or disable a Member directory.

Where a directory is enabled, eligible Members may be able to see certain profile information about other Members of the same Collective.

You should consider the purpose and culture of your Collective when deciding whether a Member directory is appropriate.

Fresh Collective controls the technical information made available through the directory.

Creators must not use Member directory information for unrelated purposes.


Member information

Operating a Collective may give you access to personal information about Members.

Depending on platform features, this may include:

  • names
  • display names
  • email addresses
  • profile information
  • membership information
  • purchase information
  • booking information
  • attendance information
  • communications
  • other information reasonably required to operate the Collective

Access to Member information is provided so you can manage your Collective and deliver the experiences Members have chosen to participate in.


Protect Member information

You must handle Member information responsibly.

You agree to:

  • use Member information only for legitimate Collective or business purposes
  • protect it from inappropriate access or disclosure
  • not sell Member information
  • not disclose it to unrelated third parties without an appropriate lawful basis
  • not use it to harass, exploit or improperly target Members
  • comply with applicable privacy, confidentiality and communications laws
  • take reasonable steps to protect information you export or store outside Fresh Collective

If you export, copy or otherwise handle Member information outside Fresh Collective, you are responsible for protecting that copy appropriately.

Fresh Collective's Privacy Policy explains how Fresh Collective handles information through the platform.


Contacting Members outside Fresh Collective

Access to Member information does not automatically give you unrestricted permission to send promotional communications.

If you contact Members outside Fresh Collective, you are responsible for complying with applicable laws relating to:

  • privacy
  • electronic marketing
  • consent
  • sender identification
  • unsubscribe requirements

You should distinguish communications reasonably necessary to provide something a Member has requested from separate promotional or marketing communications.


Communicating with Members

Creators are expected to communicate openly and reasonably with Members.

This includes communicating material information about matters such as:

  • purchases
  • Gatherings
  • cancellations
  • significant schedule changes
  • changes to paid offerings
  • changes that materially affect Member access

Fresh Collective may provide platform tools and automated communications to assist with this.

Creators remain responsible for information specific to their own offering.


Community moderation

Creators are responsible for helping maintain the culture of their own Collectives.

Creators may moderate participation using the tools made available through Fresh Collective.

Depending on the circumstances, you may:

  • communicate with a Member about behaviour
  • remove inappropriate Community Contributions
  • restrict participation
  • change access
  • suspend participation
  • remove a Member from your Collective

Moderation should be exercised reasonably and consistently with:

  • the Community Guidelines
  • the Terms of Use
  • this Agreement
  • applicable law

Serious behaviour may justify immediate action.

Creators are not required to follow a particular sequence of warnings where immediate action is reasonably necessary.


Removing a Member

You may remove a Member from your Collective where there is a legitimate reason to do so.

Examples may include:

  • serious or repeated Community Guidelines breaches
  • harassment
  • threats
  • misuse of the Collective
  • significant disruption
  • fraudulent activity
  • another substantial breach of applicable terms

Removing someone from a Collective and determining their financial rights are separate matters.

Removal does not automatically mean:

  • every payment is forfeited
  • every payment must be refunded
  • remaining financial commitments disappear

Any refund, cancellation or remaining payment obligation must be considered separately under:

  • the applicable purchase terms
  • the Payment, Refund & Cancellation Policy
  • Australian Consumer Law
  • other applicable law

Gatherings

Creators may offer Gatherings through Fresh Collective.

Gatherings may be:

  • in person
  • online
  • one-off
  • recurring
  • part of a Series
  • free
  • paid
  • included through another purchase

Creators are responsible for providing accurate Gathering information.

This may include:

  • date and time
  • location information
  • capacity
  • what participants should bring
  • accessibility information where relevant
  • participation requirements
  • booking conditions
  • cancellation information
  • other material information

Public and private venue information

Fresh Collective may distinguish between public location information and private attendee information.

For example, a public Gathering may display a general location such as:

South Croydon, Victoria

while the precise street address or access instructions are only shown to eligible attendees or people managing the Gathering.

Creators are responsible for entering location information into the appropriate fields.

You should not place private residential addresses, access codes or other sensitive venue information into fields intended for public display.


Safety at Gatherings and experiences

Creators are responsible for taking reasonable steps to operate their Gatherings and experiences safely.

Depending on the activity, this may include:

  • assessing foreseeable risks
  • providing appropriate instructions
  • using suitable venues or equipment
  • maintaining reasonable participant limits
  • having appropriate emergency arrangements
  • obtaining required licences or permits
  • holding relevant qualifications
  • maintaining appropriate insurance
  • obtaining activity-specific consents or waivers where appropriate

Fresh Collective provides platform infrastructure.

Fresh Collective does not supervise or independently approve every activity offered by every Creator.


Professional and regulated activities

If your Collective involves services that require:

  • professional registration
  • accreditation
  • licences
  • permits
  • qualifications
  • insurance
  • professional standards

you are responsible for ensuring those requirements are met.

You must not misrepresent your qualifications, experience or authority to provide a service.

Fresh Collective's acceptance of your Creator account does not represent professional accreditation or endorsement.


Health, wellbeing and similar services

Some Creators may provide services relating to areas such as:

  • movement
  • fitness
  • wellbeing
  • coaching
  • personal development
  • education

Creators remain responsible for describing their services accurately and staying within the scope of their qualifications and experience.

You must not make misleading claims about likely results or outcomes.

Where an activity requires health information, screening, informed consent, waivers or other activity-specific processes, the Creator is responsible for putting appropriate arrangements in place.


Pricing

Creators determine the prices of their own offerings using the options supported by Fresh Collective.

You are responsible for ensuring pricing is:

  • accurate
  • clearly described
  • not misleading
  • consistent with what will actually be provided

Before a Member purchases, the offer should clearly explain relevant matters such as:

  • the amount payable
  • what is included
  • whether payment is one-off, recurring or by instalments
  • any access period
  • relevant booking limits
  • other material purchase conditions

One-off purchases

Creators may offer experiences through a single payment.

You must clearly describe what the Member receives in exchange for that payment.

A one-off purchase must not be presented as including ongoing access unless that is genuinely part of the offer.


Ongoing subscriptions

Where you offer an ongoing subscription, Members should be able to understand:

  • the recurring amount
  • billing frequency
  • what is included
  • whether there is any minimum term
  • how cancellation works

You must not misleadingly present an ongoing subscription as a one-time purchase.

Where cancellation is supported through Fresh Collective, you must not require Members to use unnecessary additional steps to cancel.


Fixed payment plans

Fresh Collective may allow Creators to offer a fixed total purchase price paid in instalments.

For example:

$37.80 per week for 10 weeks Total commitment: $378.00

A fixed payment plan is not the same as an ongoing subscription.

Where you offer a fixed payment plan, Members should clearly understand:

  • the total purchase price
  • each instalment amount
  • the payment frequency
  • the number of instalments
  • what is included

Creators must not describe a fixed financial commitment in a misleading way.

The Payment, Refund & Cancellation Policy explains how fixed payment plans operate.


Payment options and access grants

Fresh Collective may allow Creators to configure Payment Options that provide particular forms of access.

Depending on platform functionality, a purchase may grant:

  • Collective membership
  • Pathway access
  • Gathering Series access
  • resource access
  • booking allowances
  • other defined access

Creators are responsible for reviewing these settings before publishing an offering.

The access configured through the Payment Option should match what is represented to the Member.


Purchase-required membership

A Creator may choose to make a Collective purchase-required where supported by Fresh Collective.

In this model, one or more eligible Payment Options may act as ways to join the Collective.

A joining purchase may provide both:

  • Collective membership
  • the specific paid access described by the purchase

Creators should ensure nominated joining options are current and genuinely available for purchase.


Refund and cancellation policies

Creators are responsible for communicating any additional refund or cancellation policy that applies to their offerings.

You may determine reasonable policies for matters such as:

  • change of mind
  • inability to attend
  • transfers
  • rescheduling
  • missed sessions

However, your policy must not remove or misrepresent rights provided by law.

You must comply with the Payment, Refund & Cancellation Policy and applicable Australian Consumer Law.

A statement such as "no refunds" must not be used in a way that suggests Members have no statutory rights where those rights apply.


Cancelling a Gathering

If you cancel or materially change a Gathering, you should communicate with affected Members promptly.

Depending on the circumstances, an appropriate response may include:

  • rescheduling
  • replacement
  • transfer
  • credit
  • partial refund
  • full refund
  • another appropriate remedy

Creators should consider:

  • what was purchased
  • what can still be provided
  • the effect of the change on the Member
  • their published policy
  • applicable consumer law

Payment processing

Fresh Collective uses payment service providers to process payments.

Fresh Collective does not generally store complete payment card or bank account details.

By using Fresh Collective's payment functionality, you authorise Fresh Collective and its payment providers to process transactions associated with your Creator activity in accordance with:

  • this Agreement
  • the applicable Creator plan
  • the Payment, Refund & Cancellation Policy
  • payment provider requirements

Creator payouts

Where Fresh Collective collects payments associated with your offerings, amounts may be included in Creator payout and reconciliation processes.

The amount available for payout may reflect:

  • Member payments
  • refunds
  • platform fees
  • payment processing amounts
  • reversals
  • disputes
  • adjustments
  • other transaction corrections

Fresh Collective may provide Creator-facing records showing how payout amounts were calculated.


Payout adjustments

Sometimes a transaction needs to be corrected after an initial payment or payout calculation.

For example:

  • a Member may receive a refund
  • a payment may be reversed
  • a transaction may be disputed
  • an administrative correction may be required

Where appropriate, the corresponding amount may be:

  • removed from a pending payout
  • offset against another amount payable to you
  • included as an adjustment in a future payout
  • otherwise reconciled reasonably

Fresh Collective will aim to maintain clear records of these adjustments.


Payment disputes and chargebacks

A Member may dispute a payment through their bank or payment provider.

Where a transaction is disputed, Fresh Collective may reasonably:

  • investigate the transaction
  • provide relevant transaction information to the payment provider
  • temporarily hold an associated payout
  • adjust an associated payout
  • restrict access associated with a disputed payment while the matter is being resolved

You agree to provide reasonable information required to help investigate a dispute involving your offering.

The outcome of a payment-provider dispute does not necessarily determine every legal right between the Creator, Member and Fresh Collective.


Platform fees

Fresh Collective may charge platform fees associated with Creator activity.

The applicable fee structure will be shown as part of your Creator plan or other relevant pricing information.

Platform fees may differ depending on:

  • the Creator plan
  • promotional or founding arrangements
  • the type of transaction
  • another arrangement expressly offered by Fresh Collective

Fresh Collective will not retrospectively change the fee already applicable to a completed transaction.

Any change affecting future transactions will be communicated in accordance with the relevant plan and applicable law.


Creator plans and subscriptions

Fresh Collective may offer different plans for Creators.

A Creator plan may include:

  • a recurring subscription fee
  • different platform fees
  • access to particular features
  • usage or feature limits
  • other benefits

Before starting a paid Creator plan, the applicable pricing and recurring billing arrangement should be shown.

Where a Creator plan is an ongoing subscription, it will continue until cancelled unless otherwise stated.


Cancelling a Creator subscription

You may cancel an ongoing Creator subscription through the available account controls.

Cancellation generally prevents the next subscription renewal.

Cancellation may affect your access to Creator functionality after the current paid period ends.

Cancelling your Creator subscription does not automatically remove obligations connected with:

  • existing Member purchases
  • refunds
  • outstanding transactions
  • payment disputes
  • Creator payouts
  • your responsibility for content or Member information

Fresh Collective may provide reasonable options for resolving existing commitments where Creator functionality is ending.


Taxes and business obligations

Creators are responsible for understanding and meeting their own tax and business obligations.

Depending on your circumstances, this may include:

  • income tax
  • GST
  • business registration
  • Australian Business Number requirements
  • accounting and record keeping
  • invoicing
  • other tax obligations

Fresh Collective does not provide individual taxation advice.

Information displayed through Fresh Collective may assist with record keeping but should not be treated as professional tax advice.

You should seek independent advice where necessary.


Insurance

Fresh Collective does not automatically provide insurance for every Creator activity.

You are responsible for determining whether your activities require or would reasonably benefit from insurance.

Depending on your work, this may include:

  • public liability insurance
  • professional indemnity insurance
  • product liability insurance
  • event insurance
  • other relevant cover

Where Fresh Collective requires particular insurance for a type of activity, you agree to provide evidence of that cover where reasonably requested.


Legal and regulatory compliance

Creators are responsible for complying with laws that apply to their own activities.

Depending on the nature of the Collective, this may include laws relating to:

  • consumer protection
  • privacy
  • intellectual property
  • electronic communications
  • workplace or contractor obligations
  • professional regulation
  • health and safety
  • taxation
  • discrimination
  • venue or event requirements
  • other relevant regulation

Fresh Collective's platform tools do not replace your responsibility to understand requirements specific to your work.


Australian Consumer Law

Creators offering goods or services to consumers must comply with applicable Australian Consumer Law.

This includes obligations relating to matters such as:

  • misleading or deceptive conduct
  • false representations
  • consumer guarantees
  • unfair contract terms
  • pricing
  • refunds and remedies

You must not use your own terms, disclaimers or refund policies to suggest that rights which cannot lawfully be excluded do not apply.

Fresh Collective may require a Creator to correct information or practices that appear inconsistent with consumer law or Fresh Collective's platform requirements.


Community Guidelines

Creators are expected to model the standards set out in the Community Guidelines.

Creators have additional influence within their own Collectives and should exercise that influence responsibly.

Creators must not use their position to:

  • harass Members
  • intimidate Members
  • exploit Members
  • retaliate against legitimate complaints
  • discriminate unlawfully
  • misuse private Member information
  • manipulate community participation dishonestly

Creators should contribute to communities where people can participate without unnecessary fear of humiliation, harassment or exploitation.


Reporting concerns

Members may raise concerns about a Creator or Collective with Fresh Collective.

Fresh Collective may review concerns relating to matters such as:

  • Community Guidelines breaches
  • platform misuse
  • safety
  • fraud
  • misleading conduct
  • privacy
  • harassment
  • serious Member complaints
  • unlawful activity

Fresh Collective may request information from the Creator where reasonably necessary to understand the issue.


Fresh Collective moderation

Fresh Collective is responsible for the integrity of the wider platform.

Where necessary, Fresh Collective may take reasonable action in response to:

  • serious or repeated breaches of this Agreement
  • breaches of the Terms of Use
  • Community Guidelines breaches
  • security risks
  • fraud
  • legal requirements
  • serious safety concerns
  • material misuse of Fresh Collective

Depending on the circumstances, action may include:

  • requesting corrective action
  • removing content
  • restricting particular functionality
  • pausing an offering
  • limiting access
  • suspending Creator functionality
  • suspending an account
  • closing an account

Where reasonably practicable, Fresh Collective will explain significant action taken against a Creator.

Immediate action may be necessary in serious cases.


Suspending a Creator

Fresh Collective may suspend Creator functionality where reasonably necessary to:

  • protect Members
  • investigate serious concerns
  • respond to fraud or security risks
  • comply with law
  • prevent continuing harm
  • address a serious breach of Fresh Collective terms

Suspension does not automatically remove existing obligations to Members.

Fresh Collective and the Creator may still need to address:

  • existing purchases
  • upcoming Gatherings
  • refunds
  • payment plans
  • payouts
  • Member communications
  • access to purchased content

Closing a Collective

You may choose to stop operating a Collective.

Before closing it, you are responsible for considering existing commitments to Members.

This may include:

  • active subscriptions
  • fixed payment plans
  • future Gatherings
  • current programs
  • Pathway access
  • Member purchases
  • refunds
  • Community Contributions
  • communications with affected Members

You should not accept new payments for an offering you know you will not be able to provide.

Where possible, you should give Members reasonable notice of a planned closure.


Existing paid commitments

Closing a Collective does not automatically cancel existing contractual or consumer obligations.

Depending on the circumstances, you may need to:

  • complete an existing offering
  • stop future payments
  • refund affected Members
  • provide alternative access
  • provide a credit
  • make another appropriate arrangement

Fresh Collective may assist with the technical administration of these outcomes.


Leaving Fresh Collective

You may stop using Fresh Collective as a Creator.

Before leaving, you must reasonably address outstanding matters connected with your Creator activity.

This may include:

  • Member purchases
  • refunds
  • payment plans
  • Creator payouts
  • scheduled Gatherings
  • disputes
  • Member communications
  • exported Member information

Fresh Collective may retain information where reasonably necessary for:

  • transaction records
  • dispute resolution
  • legal compliance
  • security
  • accounting
  • other legitimate purposes described in the Privacy Policy

What happens to Creator Content when you leave

When your Collective or Creator account closes, public access to your Creator Content may end.

Fresh Collective may retain copies where reasonably necessary for:

  • backups
  • transaction records
  • legal requirements
  • dispute resolution
  • security records
  • other legitimate retention purposes

Where content remains necessary to fulfil an existing Member purchase, Fresh Collective and the Creator may need to determine how that access will be handled before the Collective closes.

Closing an account does not transfer ownership of Creator Content to Fresh Collective.


Platform changes

Fresh Collective will continue to evolve.

Features may be:

  • introduced
  • improved
  • replaced
  • redesigned
  • removed
  • temporarily unavailable

Fresh Collective will aim to avoid unnecessarily disrupting existing Creator and Member commitments.

Where a significant platform change materially affects a paid Creator feature or existing Member offering, Fresh Collective will take reasonable steps to communicate the change and address existing commitments.


Platform availability

Fresh Collective aims to provide a reliable service but does not promise uninterrupted availability.

From time to time, access may be affected by:

  • maintenance
  • updates
  • technical failures
  • third-party service failures
  • security issues
  • events outside reasonable control

Fresh Collective will take reasonable steps to restore services and minimise disruption.

Nothing in this section excludes rights or guarantees that cannot lawfully be excluded.


Working together

Fresh Collective is built around three connected roles.

Platform Owner

Fresh Collective operates the platform, maintains shared infrastructure and provides tools that allow Creators and Members to participate.

Creator

Creators build and lead Collectives.

They create experiences, resources and communities and are responsible for what they offer.

Member

Members choose where they participate.

They bring Collectives to life through participation, contribution, learning and connection.

The roles are different, but the health of Fresh Collective depends on each respecting the responsibilities of the others.


Other terms that apply

This Creator Agreement forms part of Fresh Collective's wider governance framework.

Depending on your activity, the following may also apply:

  • Terms of Use
  • Privacy Policy
  • Community Guidelines
  • Payment, Refund & Cancellation Policy
  • Membership Terms
  • your applicable Creator plan
  • terms displayed for a particular transaction or offering
  • additional requirements applying to a particular activity

Nothing in these documents excludes rights or obligations that cannot lawfully be excluded.


Changes to this Agreement

Fresh Collective may update this Agreement as the platform evolves.

Changes may be made to reflect:

  • new platform functionality
  • changes to Fresh Collective's business model
  • legal or regulatory requirements
  • improvements to Creator or Member protections
  • changes to shared platform processes

Where changes are material, Fresh Collective will provide reasonable notice where practicable.

Fresh Collective will not use an updated Agreement to retrospectively alter the agreed price or essential financial terms of a completed transaction.

Where a proposed change affects an ongoing Creator subscription or other existing contract, it will be managed in accordance with applicable law.

The current published version will always be available through the World Guide.
